New non-prescription therapeutic goods advertising code
The revised Therapeutic Goods Advertising Code came into effect on 1 January 2019, marking one of the most significant updates to health product marketing in recent years.
The code sets strict standards for what you may say, what you must say, and who you can target when advertising therapeutic goods in Australia – even if your product is available without a prescription.
What the Code covers
The Code applies to all advertising for therapeutic goods directed to the public – including:
- Packaging, labels and point-of-sale materials
- Digital and print advertising
- Social media campaigns and influencer marketing
- Websites, brochures and other promotional material
It specifies:
- What information must be included (for example, mandatory health warnings or ingredient disclosures)
- What cannot be claimed (such as unproven benefits or misleading medical implications)
- Which audiences cannot be targeted (including vulnerable groups like children or pregnant women)
Who needs to pay close attention
If your business operates in any of the following sectors, you should review your advertising and packaging urgently:
- Weight management and dietary supplements
- Pharmacy, over-the-counter or complementary medicines
- Children’s health and family care products
The Therapeutic Goods Administration (TGA) has made it clear that non-compliance can result in penalties, including public sanctions, product withdrawal, or significant fines.
Why this matters
Even if your products appear “low-risk,” they may still be considered therapeutic goods under the Code.
If your packaging or advertising suggests a therapeutic purpose – for example, “reduces inflammation,” “aids weight loss,” or “boosts immunity” – your marketing materials must comply with TGA regulations.
